These terms govern your use of the Golden Point app for Apple Watch and this website. By downloading or using the app, you agree to them. If you don't agree, please don't use the app.
01Acceptance of these terms
By installing, accessing or using Golden Point ("the app"), you confirm that you accept these terms and agree to comply with them. These terms form an agreement between you and the developer of Golden Point ("we", "us").
02Licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to download and use Golden Point on Apple devices that you own or control, for your own non-commercial use, in accordance with the App Store Terms of Service and these terms.
03Acceptable use
You agree not to:
- copy, modify, reverse-engineer, decompile or attempt to extract the source code of the app, except to the extent the law expressly permits;
- rent, lease, sub-license, sell or otherwise commercialise the app;
- remove or alter any proprietary notices; or
- use the app in any way that breaks applicable law.
04App Store terms
Golden Point is distributed through the Apple App Store. Your download and use is also subject to Apple's Media Services Terms. Apple is not a party to these terms and is not responsible for the app or its support; as the developer, we are solely responsible for the app and any claims relating to it, to the extent required by Apple's standard End User Licence Agreement.
05Intellectual property
The app, its name, logo, design and all related content are owned by us and protected by intellectual-property laws. These terms grant you a licence to use the app — they do not transfer any ownership to you. "Apple Watch" and "Apple Health" are trademarks of Apple Inc.; Golden Point is an independent app and is not endorsed by or affiliated with Apple.
06Your data & backups
Your matches, statistics and settings are stored locally on your Apple Watch. We don't receive or store this data. You're responsible for your own backups — for example through Apple's backup services. We aren't liable for data lost if the app is deleted, a device is reset, or storage is otherwise cleared. How the app handles data is described in our Privacy Policy.
07Disclaimer of warranties
The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We don't warrant that the app will be uninterrupted, error-free, or that scores recorded will be free of mistakes — you remain responsible for confirming the result of your matches. Golden Point is a scoring aid for recreational play, not an official scoring authority.
08Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special or consequential damages, or for any loss of data, arising from your use of (or inability to use) the app. Nothing in these terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence.
09Changes to the app and terms
We may update the app and these terms from time to time. When we make material changes to these terms we'll update the "last updated" date above. Continuing to use the app after changes take effect means you accept the updated terms.
10Governing law
These terms are governed by the laws of England and Wales, and disputes will be subject to the exclusive jurisdiction of its courts, unless mandatory local consumer-protection laws in your country of residence say otherwise.
